In the motion, HomeServices claimed that no evidence has been presented to show they conspired with the National Association of Realtors (NAR) and other brokerages on rules for commissions. In her testimony, she noted that training modules receive very few views.

Ketchmark said the plaintiffs want the defendants, which include the National Association of Realtors , HomeServices of America and Keller Williams , to “return the money” they believe was unlawfully taken via commissions as a result of an alleged conspiracy between the defendants. I do believe training is essential.”

The lawsuit, which was originally filed in 2019 and won class-action status in April, alleges that some NAR rules, including one that requires listing brokers to offer buyer brokers a commission to list a property in a Realtor-affiliated MLS, violate the Sherman Antitrust Act by inflating seller costs.
